Hemp Applications Are Ready To Submit March 16th.

Co-chair of the Texas Industrial Hemp Council Eloise Frischkorn spoke with Sid Miller at Houston Rodeo on Wednesday about hemp applications.

In a video shared on Youtube, Sid Miller explains the application to grow hemp in the state of Texas.

Miller explains that they will obviously need your name. One will need to mark new business – all are a new business in Texas, no renewals.

The form will require your business name and owner name, from there you will check if you are sole proprietor, co-owner, etc and tax id number. If you are the sole proprietor your social security number will suffice.

The form will require individuals to enter their driver’s license number and personal information such as address. This will be needed for the required background check. As well, the business address will be required – mailing address if different from the location of the grow operation.

Applicants will need to enter a person to contact for related matters. This would be individuals such as ranch managers, operation managers, etc.

Applicants will be required to list all key participants such as partners to run background checks. Miller did not clarify in the video who key participants are defined as. The Texas Administrative Code website does state though,

“Key participants” means a sole proprietor, a partner in a general partnership, a general partner in a limited partnership, or a person with executive managerial control in an entity. A person with executive managerial control includes persons such as a trustee, independent or dependent executor or administrator of an estate, chief executive officer, managing member, manager, president, vice president, general partner, chief operating officer and chief financial officer, or their equivalents. This definition does not include non-executive employees such as farm, field, or shift managers that do not make financial planning decisions and that do not vote or exercise control of an entity.

The application will require applicants to document the purpose of their hemp. Miller lists off paper, paint, particle, board, plastics, drugs, cosmetics, etc as examples.

Facility location will be needed for DEA and DPS as required per Farm Bill 2018 and Texas law. This will require a physical address with GPS coordinates. Miller notes the easiest way to find this is to use a smartphone and a map application. If you have multiple locations, each will need to be provided in the same manner.

The fees will cost $100 per facility and $100 per license. Only one license is needed to operate multiple facilities.

Applicants must fill everything out. Miller instructs the viewer that they do not leave anything blank and must sign the form. Blank areas will result in rejection.

There are some questions that will be on the back of the form. Miller states if you fail it, it will not be good.

Miller says the form is not complicated and that the form will be online and must be submitted online. If you’re not comfortable doing it online, one can go to one of 5 regional locations located in Lubbock, Dallas, Houston, San Antonio and the Valley.
